Based on the last statements of the data protection conference (a body of the data protection supervisory authorities of the federal and state governments) and due to the new cookie judgment of the European Court of Justice on October 1st, 2019, it is recommended to opt for tracking mechanisms such as Google Analytics, Google Double Click, GA Audience and the like and for the setting of cookies that are not technically necessary for the operation of the website, to obtain the consent of the website visitors.
Otherwise there is a certain risk, for example a competition law warning or a complaint (and in the worst case, fine) by the data protection supervisory authority. This procedure will be absolutely necessary at the latest when the ePrivacy Regulation 2020 comes into force, which is intended to supplement the existing General Data Protection Regulation (GDPR) and will close any gaps in the regulations.
In general, for all tracking mechanisms, statistical tools, pixels, etc. and technically unnecessary cookies the consent of website visitors can be obtained.
For this purpose, a real opt-in & out procedure must be selected, i.e. a technical procedure must be implemented that ensures that, for example, a tracking cookie is only set when the website visitor has also consented to this by actively clicking on it. The website visitor must also be able to revise and adjust their settings at any time (opt-out procedure).
To implement a real opt-in & out procedure including the provision of a cookie banner on your WordPress site, we offer you our WP simple cookie plugin on the WordPress content management system. This plugin enables you to inform your visitors about the use of your cookies and services and to integrate an opt-in & out procedure for your used mechanisms. In addition, the plug-in offers further options to protect your website visitors from unsolicited disclosure of personal data to third-party providers and to recognize and block third-party services.
For most website operators, e-privacy is still cumbersome further to the EU General Data Protection Regulation (GDPR) and only a few know how to deal with it in a technically clean manner.
Many providers are already trying out this area, but unfortunately there is still no user-friendly solution that is effective and that also helps website operators without technical and legal background to comply with the latest regulations.
